Rodolfo Sacco developed the idea of “mute behaviours” during his studies on mute law. The notion of “mute behaviours” denotes an action that is able to mould a legal relationship without any use of language. Certainly, this concept may give rise to some doubts in relation to the attribution—to a behaviour qualified as mute—of the capability to affect dynamics involving a plurality of people. Aiming to clarify the idea of “mute behaviours” by this point of view, the authors analysed the (...) semiotic terminology used by Sacco himself to explain this notion and the issue of its silent nature. Therefore, the terms “signifying signs” and “symptoms”, deemed by Sacco—respectively—incompatible and compatible with the theory of mute behaviours were considered. The former term was traced back to the notion of conventional and arbitrary sign, the notion of the latter was reconstructed linking it to the concept of signs based on signification and suggesting a possible framework in view of the idea of “presentative meanings” developed by the philosopher Guido Morpurgo-Tagliabue. Clarified this dichotomy by a terminological analysis, the authors noticed—as affirmed by Rodolfo Sacco himself—the impossibility to ascribe the notion of gesture to the mute behaviour’s category, as some exegetes proposed. Consequently to this last remark, the authors tried to analyse the relationship between gestures and “mute behaviours”, identifying the category of “sema-pragmatic acts”, that includes gestures and may be seen as an intermediate phase between “mute behaviours” and legally relevant behaviours operated by speaking. Schizophrenia spectrum has been associated with a disruption of the basic sense of self, which pertains, among others, the representation of one’s own body. We investigated the impact of either implicit or explicit access to the representation of one’s own body-effectors on bodily self-awareness, in first-episode schizophrenia patients and healthy controls . We contrasted their performance in an implicit self-recognition task and in an explicit self/other discrimination task. Both tasks employed participant’s own and others’ body-effectors. Concerning the implicit task, HCs (...) were more accurate with their own than with others’ body-effectors, whereas patients did not show such self-advantage. Regarding the explicit task, both groups did not exhibit a self-advantage, and patients showed a higher percentage of self-misattribution errors. Neither self/other nor implicit/explicit effects were found in both groups when processing inanimate-objects. We propose that FES patients suffer of a disturbed implicit sense of bodily self. In recent decades, the digital age and the Third Industrial Revolution have attracted significant attention in terms of their benefits and risks. Scholars have explored the impact of these changes on autonomy, freedom, human interactions, cognition, and knowledge sharing. However, the influence of the digital communicative environment on civic interactions and public deliberation processes has received limited attention from virtue theorists. This paper aims to address this gap. First, we discuss the challenges posed by the digital communicative environment, and we (...) present recent attempts to revive civility within this context. Then, we propose a twofold account of civility as consisting in the two virtues of civic benevolence and civil deliberation. This opening piece of the special issue ‘Perspectives on Post-Truth’ aims to accomplish three tasks. First, and foremost, it highlights the issue’s distinctive feature, namely its variegated approach to post-truth. The leading idea in assembling it has been to draw on different methodologies, theoretical approaches, and competences, in order to gain a fine-grained understanding of the post-truth condition and to develop an effective toolkit to address the most pressing challenges it poses to our societies. The underlying conviction is that a (...) variegated approach is required by the multifaceted nature of the post-truth condition. The curious reader willing to venture through the issue will thus be exposed to different perspectives on post-truth: some pieces address it from a traditional epistemological perspective, others explore post-truth from the perspective of social epistemology, and still others adopt a semiotic perspective. In light of this multiplicity of perspectives, the second task of this piece has been to provide a brief thematic overview of the key issues and perspectives in order to illustrate the overall narrative of the project. This research aims to examine access to medical treatment during the COVID-19 pandemic for people living with disabilities. During the COVID-19 pandemic, the practical and ethical problems of allocating limited medical resources such as intensive care unit beds and ventilators became critical. Although different countries have proposed different guidelines to manage this emergency, these proposed criteria do not sufficiently consider people living with disabilities. People living with disabilities are therefore at a higher risk of exclusion from medical treatments as physicians (...) tend to assume they have poor quality of life, whereas access to medical treatment should be based on several parameters, including clinical data and prognosis. However, the COVID-19 pandemic shifts the medical paradigm from person-centred medicine to community-centred medicine, challenging the main ethical theories. We reviewed the main guidelines and recommendations for resources allocation and examined their position toward persons with disabilities. Based on our findings, we propose criteria for not discriminating against people with disabilities in allocating resources. The shift from person-centred to community-centred medicine offers opportunities but also risks sacrificing the most vulnerable people. The principle of reasonable accommodation must always be considered to guarantee the rights of persons with disabilities. (shrink)

BackgroundInformation and communication technology solutions have the potential to support active and healthy aging and improve monitoring and treatment outcomes. To make such solutions acceptable, all stakeholders must be involved in the requirements elicitation process. Due to the COVID-19 situation, alternative approaches to commonly used face-to-face methods must often be used. One aim of the current article is to share a unique experience from the Pharaon project where due to the COVID-19 outbreak alternative elicitation methods were used. In addition, an (...) overview of common functional, quality, and emotional goals identified by six pilot sites is presented to complement the knowledge about the needs of older adults.MethodsOriginally planned face-to-face co-creation seminars were impossible to carry out, and all pilot sites chose alternative requirements elicitation methods that were most suitable in their situation. The elicited requirements were presented in the form of goal models. In one summary goal model, we provide an overview of common functional, quality, and emotional goals.ResultsDifferent elicitation methods were combined based on the digital literacy of the target group and their access to digital tools. Methods applied without digital technologies were phone interviews, reviews of literature and previous projects, while by means of digital technologies online interviews, online questionnaires, and virtual co-creation seminars were conducted. The combination of the methods allowed to involve all planned stakeholders. Virtual and semi-virtual co-creation seminars created collaborative environment comparable to face-to-face situations, while online participation helped to save the time of the participants. The most prevalent functional goals elicited were “Monitor health,” “Receive advice,” “Receive information.” “Easy to use/comfortable,” “personalized/tailored,” “automatic/smart” were identified as most prevalent quality goals. Most frequently occurring emotional goals were “involved,” “empowered,” and “informed.”ConclusionThere are alternative methods to face-to-face co-creation seminars, which effectively involve older adults and other stakeholders in the requirements elicitation process. Despite the used elicitation method, the requirements can be easily transformed into goal models to present the results in a uniform way. The common requirements across different pilots provided a strong foundation for representing detailed requirements and input for further software development processes. (shrink)

With the advent of the severe acute respiratory syndrome-Corona Virus type 2 pandemic, the theme of emotion recognition from facial expressions has become highly relevant due to the widespread use of face masks as one of the main devices imposed to counter the spread of the virus. Unsurprisingly, several studies published in the last 2 years have shown that accuracy in the recognition of basic emotions expressed by faces wearing masks is reduced. However, less is known about the impact that (...) wearing face masks has on the ability to recognize emotions from subtle expressions. Furthermore, even less is known regarding the role of interindividual differences in emotion processing. This study investigated the perception of all the six basic emotions, both as a function of the face mask and as a function of the facial expressions’ intensity in terms of participants’ uncertainty in their responses, misattribution errors, and perceived intensity. The experiment was conducted online on a large sample of participants. Participants completed the 20-item Toronto Alexithymia Scale and the Autistic Spectrum Quotient and then performed an emotion-recognition task that involved face stimuli wearing a mask or not, and displaying full or subtle expressions. Each face stimulus was presented alongside the Geneva Emotion Wheel, and participants had to indicate what emotion they believed the other person was feeling and its intensity using the GEW. For each combination of our variables, we computed the indices of ‘uncertainty’, ‘bias’, and ‘perceived intensity’. We found that face masks increase uncertainty for all facial expressions of emotion, except for fear when intense, and that disgust was systematically confused with anger. Furthermore, when faces were covered by the mask, all the emotions were perceived as less intense, and this was particularly evident for subtle expressions. Finally, we did not find any evidence of a relationship between these indices and alexithymic/autistic traits. (shrink)

Forest Ecosystem Services are widely recognised by the society nowadays. However, no study in the literature has analysed a ranking of FES after the pandemic. This paper investigated civil society’s perception and knowledge toward these services; in addition, the presence of attitudinal or behavioural patterns regarding individual’s preference, was assessed. A choice experiment was conducted using the Best-Worst Scaling method on a sample of 479 individuals intercepted in the Argentera Valley, in the Western Italian Alps. Results, showed a strong interest (...) in biodiversity, aesthetic landscape quality and psychophysical health and a lower interest in provisioning services. Based on the individual preferences, civil society was clustered into five groups for FES, named “Hedonistic,” “Individualist with cultural and health interests,” “Sensitive to regulatory and utilitarian functions,” “Climate change sensitive” and “Livelihood and hedonistic wellbeing.” In general, there was a growing appreciation by civil society for the intangible services offered by the forest, driven by modern lifestyles and an interest in learning more about the provided services. Based on these elements, we believe that similar research should be extended to other mountain contexts to validate the results or to find new insights, and that it is now necessary to study how to involve civil society in decision-making processes of forest planning and management at a local level. Simone Martini’s panel painting of St Ladislas of Hungary, founder of the Árpád dynasty and a prototypical crusading knight, attests to the transnational character of Filippo Sangineto’s patronage in Santa Maria della Consolazione, Altomonte (Calabria). The attribution to Sangineto, count of Altomonte and seneschal of Provence, has long been debated, but he is agreed to have been a formidable patron with an ambitious plan for Altomonte. Like many Italian royals, aristocrats, cardinals, and merchants, Filippo commissioned artworks to (...) Sienese artists in Avignon. This study’s approach also sheds light on the iconography as the choice of Ladislas can be connected to the Crusade of Smyrna (1343-1345). The article proposes a reconstruction of Santa Maria della Consolazione, with two small, matching polyptychs set against the screen, one by Bernardo Daddi (two wings survive in Altomonte) and the other by Simone, composed of the painting of Ladislas and the Phillips Collection’s Christ on the Cross. We offer a critical survey of the most discussed accounts of epistemic peer disagreement that are found in the recent literature. We also sketch an alternative approach in line with a pluralist understanding of epistemic rationality.

Contemporary philosophy is beginning to pay to problems of linguistic justice the attention that they deserve in today’s heavily interconnected world. However, contemporary philosophy, as a part of today’s world, has problems of linguistic justice of its own which deserve meta-philosophical attention. At least in the philosophical tradition that is mainstream in much of the world today, viz. analytic philosophy, methodological and sociological mechanisms make it the case that the voices of non-native-speaking philosophers are substantially less heard. In this essay, (...) I briefly outline the problems non-native speakers face in contemporary analytic philosophy. I then move on to analysing the possible causes of the current problems. Among these reasons, I argue, is the emphasis given to linguistic style and appearances as signs of clarity, precision and rigour in the treatment of philosophical problems. I argue that the current emphasis on linguistic style in analytic philosophy is not justifiable, in part because it deprives contemporary analytic philosophy of a wider variety of philosophical perspectives. I argue that an important remedy for the emphasis on linguistic appearances within philosophy is to foster greater linguistic diversity. I conclude by presenting and motivating a recent initiative that aims to achieve such a goal. (shrink)

In 1436, Leon Battista Alberti wrote a letter to Filippo Brunelleschi, which he attached to a manuscript of his recently completed treatise on painting, De pictura. In it, Alberti lauded some of the Florentine artists of his day, singling out Brunelleschi for particular praise on account of the unprecedented engineering feat of constructing the cupola of the Florentine cathedral of Santa Maria del Fiore. This article undertakes a close reading of some parts of the letter, focusing especially on (...) the link that Alberti draws between great intellects and giants. Exploring the cultural traditions that might have informed Alberti’s thinking—in particular, canto XXXI of Dante’s Inferno —the article considers how the giants introduce an element of moral jeopardy, significantly complicating what might otherwise appear to be a purely celebratory text. This sense of ambivalence is further explored in relation to the ‘long exile’ from which Alberti says that his family had recently returned. Similar phrases appear in Virgil’s Aeneid and Ovid’s Metamorphoses, and consideration of these poems, it is argued, might further inflect our understanding of Alberti’s words in the letter. In this way, the article investigates how Alberti employed sophisticated literary means in order to express his own feelings regarding Brunelleschian ingegno and technical mastery; feelings that were both highly nuanced and, ultimately, unsettled. In the past two decades academic and research literature on “corruption” has flourished. During the same period organizations and initiatives fighting against corruption have also significantly expanded, turning “anti-corruption” into a new research subject. However, despite a few exceptions there is a division of labor between scholars who study corruption itself and those who study the global anti-corruption industry. Juxtaposing corruption’s local discourses and anti-corruption international practices, this article is an attempt to bring together these two intertwined research dimensions and (...) explore how an ethnographic approach might contribute to framing them together. Firstly, it describes how corruption in Romania is often conceptualized and explained in terms of national heritage, something related to old and recent cultural history, including traditional folklore. Secondly, it explores how anti-corruption works in practice, focusing on international legal cooperation projects monitoring the progress and shortcomings both prior to and post Romania’s accession to the European Union. Finally, revealing the articulations of these two apparently unrelated research fields, the article argues that corruption’s local explanations and the circular logic of auditing observed within the anti-corruption industry share a common developmental ideology mirroring the crypto-colonialist structure of power relations and dependency among European nation-states emerging out of the Cold War. We hypothesize that heritable epigenetic changes can affect rates of fitness increase as well as patterns of genotypic and phenotypic change during adaptation. In particular, we suggest that when natural selection acts on pure epigenetic variation in addition to genetic variation, populations adapt faster, and adaptive phenotypes can arise before any genetic changes. This may make it difficult to reconcile the timing of adaptive events detected using conventional population genetics tools based on DNA sequence data with environmental drivers of adaptation, (...) such as changes in climate. Epigenetic modifications are frequently associated with somatic cell differentiation, but recently epigenetic changes have been found that can be transmitted over many generations. Here, we show how the interplay of these heritable epigenetic changes with genetic changes can affect adaptive evolution, and how epigenetic changes affect the signature of selection in the genetic record. Thanks to the experimental nature of the conference where this research was originally discussed, the article offers a quick survey of the production, circulation and reception of manuscripts with philosophical texts in the Byzantine world, under a new methodology. In the first part, some of the most important manuscripts of philosophical texts are ‘stratigraphically’ analized: in this way, historiographical totem as the so-called «premier humanisme byzantin» or the «macedonian Renaissance» are discussed and revised. In the second part, I examine literary (...) evidences about the circulation of philosophical works in the different periods of Byzantine history, prudently trying to connect them with the quantitative datas which can be inferred from databases as the Mertens-Pack 3 and Pinakes. In this Chapter, Maria Kronfeldner discusses whether psychological essentialism is a necessary part of dehumanization. This involves different elements of essentialism, and a narrow and a broad way of conceptualizing psychological essentialism, the first akin to natural kind thinking, the second based on entitativity. She first presents authors that have connected essentialism with dehumanization. She then introduces the error theory of psychological essentialism regarding the category of the human, and distinguishes different elements of psychological essentialism. On that basis, Kronfeldner (...) connects historical, socio-psychological, and philosophical insights in order to show that although essentialism can act as a catalyst for dehumanization, it is not necessary for it. Examples relate to dehumanization in the context of colonialism and evolutionary thinking, to the history of dehumanizing women from Aristotle to 19th-century craniology, and to contemporary self-dehumanization and ‘lesser mind’ attribution. According to the form of logical pluralism elaborated by Beall and Restall there is more than one relation of logical consequence. Since they take the relation of logical consequence to reside at the very heart of a logical system, different relations of logical consequence yield different logics. In this paper, we are especially interested in understanding what are the consequences of endorsing Beall and Restall’s version of logical pluralism vis-à-vis the normative guidance that logic is taken to provide to reasoners. (...) In particular, the aim of this paper is threefold. First, in Sections 2 and 3, we offer an exegesis of Beall and Restall’s logical pluralism as a thesis of semantic indeterminacy of our concept of logical consequence – i.e. understood as indeterminacy logical pluralism. Second, in Sections 4 and 5, we elaborate and critically scrutinize three models of semantic indeterminacy that we think are fit to capture Beall and Restall’s indeterminacy logical pluralism. Third, in Section 6, following Beall and Restall’s assumption that the notion of logical consequence has normative significance for deductive reasoning, we raise a series of normative problems for indeterminacy logical pluralism. The overall conclusion that we aim to establish is that Beall and Restall’s indeterminate logical pluralism cannot offer an adequate account of the normative guidance that logic is taken to provide us with in ordinary contexts of reasoning. In Propelled, Elpidorou persuasively argues that the three prima facie undesirable conditions of boredom, frustration and anticipation are, in fact, importantly valuable to human life. His method is an interesting combination of existentialist explorations and reporting of cognitive science research, all written in a style more friendly to the analytic-philosophical tradition. However, I argue, the book’s precision and depth of philosophical analysis have some limitations. This is so in two main respects: first, in the relative lack of discussion of important (...) philosophical antecedents, and secondly, in the relative lack of critical engagement with some of the empirical literature the book discusses. A series of recent experimental studies have cast doubt on the existence of a traditional tension that aestheticians have noted in our aesthetic judgments and practices, viz. the problem of taste. The existence of the problem has been acknowledged since Hume and Kant, though not enough has been done to analyse it in depth. In this paper, we remedy this by proposing six possible conceptualizations of it. Drawing on our analysis of the problem of taste, we argue that the experimental (...) results in question are not a real challenge to its existence. Batteries are a fundamental storage component due to its various applications in mobility, renewable energies and consumer electronics among others. Regardless of the battery typology, one key variable from a user’s perspective is the remaining energy in the battery. It is usually presented as the percentage of remaining energy compared to the total energy that can be stored and is labeled State Of Charge (SOC). This work addresses the development of a hybrid model based on a Lithium Iron Phosphate (LiFePO4) (...) power cell, due to its broad implementation. The proposed model calculates the SOC, by means of voltage and electric current as inputs and the latter as the output. Therefore, four models based on k-Means, Agglomerative Clustering, Gaussian Mixture and Spectral Clustering techniques have been tested in order to obtain an optimal solution. (shrink)

According to the recent Perceptual Confidence view, perceptual experiences possess not only a representational content, but also a degree of confidence in that content. The motivations for this view are partly phenomenological and partly epistemic. We discuss both the phenomenological and epistemic motivations for the view, and the resulting account of the interface between perceptual experiences and degrees of belief. We conclude that, in their present state of development, orthodox accounts of perceptual experience are still to be favoured over the (...) perceptual confidence view. (shrink)

Wason’s selection task is a paramount experimental problem in the study of human reasoning, often connected with the celebrated ravens paradox in the philosophical literature. Various normative accounts of the selection task rely on a Bayesian approach. Some claim vindication of participants’ rationality. Others don’t, thus following Wason’s original intuition that observed responses are mistaken. In this article we argue that despite claims to the contrary, all these accounts actually speak to the same effect: Wason was right. First, we provide (...) a new accuracy-based analysis of the selection task that includes the existing proposals as special cases. We then show on this basis that none can actually vindicate participants’ rationality. We conclude that all normative renditions considered eventually concur: all in all, Bayesians should follow Wason in the selection task. (shrink)

Maria Kronfeldner’s Preface and Introduction to the Routledge Handbook of Dehumanization maps the landscape of dehumanization studies. She starts with a brief portrayal of the history of the field. The systematically minded sections that follow guide the reader through the resulting rugged landscape represented in the Handbook’s contributions. Different realizations, levels, forms, and ontological contrasts of dehumanization are distinguished, followed by remarks on the variety of targets of dehumanization. A discussion on valence and emotional aspects is added. Causes, functions, (...) and consequences of dehumanization, and the prospects for reducing or undoing it, are introduced. The systematic overview closes with a discussion of some important theoretical complexities that arise in studying dehumanization. After these systematic sections, the scholarly work on dehumanization gets situated in the broader intellectual landscape of debates about the ‘human’ in the humanities and social sciences. This book offers a clear, analytic, and innovative interpretation of Heidegger's late work. This period of Heidegger's philosophy remains largely unexplored by analytic philosophers, who consider it filled with inconsistencies and paradoxical ideas, particularly concerning the notions of Being and nothingness. This book takes seriously the claim that the late Heidegger endorses dialetheism--namely the position according to which some contradictions are true--and shows that the idea that Being is both an entity and not an entity is neither incoherent nor logically (...) trivial. The author achieves this by presenting and defending the idea that reality has an inconsistent structure. In doing so, he takes one of the most discussed topics in current analytic metaphysics, grounding theory, into a completely unexplored area. Additionally, in order to make sense of Heidegger's concept of nothingness, the author introduces an original axiomatic mereological system that, having a paraconsistent logic as a base logic, can tolerate inconsistencies without falling into logical triviality. This is the first book to set forth a complete and detailed discussion of the late Heidegger in the framework of analytic metaphysics. It will be of interest to Heidegger scholars and analytic philosophers working on theories of grounding, mereology, dialetheism, and paraconsistent logic. (shrink)

We argue that political propaganda is a negative phenomenon, against a recent strain of philosophical theorizing that argues that political propaganda can sometimes be neutral or even positive. After an exploration of the sense and connotation of the word ‘propaganda’ in ordinary use and in the scholarly literature, we discuss Ross’s (2002) account of propaganda as an epistemically defective form of political communication. We claim that, with some refinements, it is an explanatorily useful analysis. We then assess two prominent attempts (...) that aim at classifying legitimate cases of public communication as cases of propaganda, namely Ross’s (2013) revision of her previous model, and Stanley’s (2015) influential account. We show that some of the cases in contention are problematic and that the arguments the authors offer for classifying other non-problematic cases as propaganda are inconclusive. We also argue that the idea of considering legitimate public communication as propaganda is unmotivated. (shrink)

This book explores the various connections between Law and Opera, providing a comprehensive, multinational, and multidisciplinary resource on the subject. Further, it makes a valuable contribution to studies on law and the humanities. While, for example, the relationship between law and literature has been extensively researched, the relationship between Law and Opera remains largely overlooked. The book approaches the topic from three perspectives in three main sections: Law in Opera, Law on Opera, and Law around Opera.

Starting from R. K. Merton's now classic criticism of 'holistic' functionalism, i.e. of a functionalism which postulates social unity, universality and functional in-dispensability, the author stresses certain implications of this criticism more than they have been stressed hitherto. Classical and holistic functionalism) from H. Spencer, B. Malinowski, A. R. Radcliffe-Brown, etc to T. Parsons, postulates certain total unities (a global culture, an integrated system, etc.) in which each item (existence, actions, structures, etc.) is considered and defined on the grounds of (...) its consequences for the maintenance of the system as a whole; therefore holistic functionalism as a method is, in effect, the study of the consequences of the system on the items that compose it, since each of these items is defined within the sphere of the system and of its integrative functions. Merton's 'neo-functionalism', on the other hand, is remarkable not only in that it takes into account the 'dysfunctional' and 'nonfunctional' consequences of certain items on the system, but more especially because, within the context of functional analysis, it stresses the possible existence of structural substitutes and alternatives of functions, and therefore of latent structures which are foreign to objective functional consequences, as well as being able to deal with unanticipated and unexpected items and their consequences on the system. 'Neo-functionalism', which is susceptible of further development, is not limited to the study of the consequences of the system on its items: it can also reverse this scheme and study the consequences of certain items on the system. Merton's criticism of holistic functionalism therefore implies a broadening of the scientific resources of this method and a renewal of its interpretative scheme, thanks to which functional analysis ceases to appear as 'the* method of explaining sociology as a science, and becomes an interpretative method which complements the analysis of social structures and relations. Seen in this light the concept of structure becomes emancipated and independent of the concept of system and function; whereas, within the framework of universal functionalism, it was ancillary to the concept of function. Finally, latent structures and unconscious structures, conditions of possibility and subjective dispositions are favourable to social structures and social relations, not excluding those that are neither visible nor observable. This analysis, the author notes, is extremely meaningful and has great possibilities of development, especially in view of the structuralism recently to be noted in the human and social sciences: anthropology, history, linguistics, etc. (shrink)

I argue that Korsmeyer’s arguments in support of the peculiarity of disgust with respect to the paradox of fiction are not successful.

COVID-19 has brought to light the severity of economic inequalities by testing the capacity of the poorest families to make ends meet. Food insecurity has in fact soared all over the UK, with many people forced to rely on food support providers to not go hungry. This paper uses a unique dataset on 55 food support organizations active in Greater Manchester during the first COVID-19 wave, and 41 semi-structured interviews with food aid spokespersons and stakeholders, to shed light on what (...) they overcame, the complications and drawbacks of the food emergency response plan put in place. The results indicate that food aid organizations that remained open were surprisingly effective despite the growth in user demand and the decrease in volunteers. However, the necessity to maintain a timely supply food at all costs came with important drawbacks. The lockdown measures that followed COVID-19 not only affected the financial stability and management of the organizations, and the availability of food, but undermined the ways in which food support providers used to operate. Owing to physical distancing measures and to the increasing numbers of users, more or less intangible forms of support such as financial advice, empathic listening and human warmth were partially lost, probably when they were needed more than ever. The problem of explaining color perception has fascinated painters, philosophers and scientists throughout the history. In many cases, the ideas and discoveries about color perception in one of these categories influenced the others, thus resulting in one of the most remarkable cross-fertilization of human thought. At the end of the nineteenth century, two models stood out as the most convincing ones: Young-Helmholtz’s trichromacy on one side, and Hering’s opponency on the other side. The former was mainly supported by painters and (...) scientists, although with some noticeable exceptions as, e.g., Otto Runge, while the majority of philosophers supported the latter. These two apparently incompatible models were proven to be two complementary parts of the hugely complex chain of events which leads to human color perception. Recently, a rigorous mathematical theory able to incorporate both trichromacy and opponency has been developed thanks to the use of the language and tools of quantum information. PurposeInternational organizations are working on an unprecedented number of development initiatives relevant to people with disabilities. This makes it essential for the global disability community to be able to participate effectively in the decision-making processes associated with these programs. In light of this, this study aims to explore whether information technologies can help create a more inclusive global governance, forming the basis for equitable development for people with disabilities.Design/methodology/approachThe results of a global survey of disabled people’s organizations’ leaders are discussed. This asked disability rights advocates about their experiences with accessibility and barriers to effective participation, low-cost accessible technological solutions for remote participation and freely available “off-the-shelf” online technologies – in particular social media platforms – to bridge the gap between the disability community and global governance processes.FindingsAlthough only a small number of international conferences offer accessible virtual participation through web conferencing and other tools, responses from DPO advocates suggest that there is a strong demand for this technology and provide evidence of its potential for improving accessibility in global governance. Furthermore, disability organizations all over the world have embraced social media platforms to liaise with their grassroots and enable them to part-take in policy-making processes.Originality/valueThis study highlights community-backed technological solutions to persisting barriers that systematically exclude people with disabilities from fundamental global governance processes, illuminating the nexus of disability, accessibility, and participation. The last quarter of a century has featured a surge in interest and studies on the commons, spearheaded, of course, by the efforts of Elinor Ostrom. These efforts have problematized the once well-established paradigm of the tragedy of the commons most clearly described by Garrett Hardin in 1968. One could say that the commons, thus, have become a fundamental field of study in most social sciences. This is not the case in the field of legal scholarship, which leads me to (...) the overarching issue of this essay, namely the difficult relationship between jurists and the commons. The phrase?difficult relationship? does not refer to an explicit antagonism, but to something even worse: complete indifference and a scandalous lack of knowledge. While my main purpose is to try to explain this sorry state of affairs, I also hope to make a more general point on the nature of law and legal change. In this sense, the commons can be considered a case-study in legal theory. The main issue of this paper is to tackle following sub-questions. What is the status of commons in the Western European legal discourse? Why do most legal scholars pay such a poor attention to the growing literature on the commons in other disciplines?
